Question:

Salam alaykummolanasb,

I was wondering if you could let me know if divorce has taken place here. It is very urgent.

Yesterday, my wife and I were arguing over something and in the middle of the argument I said the following: ‘I will divorce you’. By saying this I did not intend divorce.

Does talak/divorce occur? I only said it once.

Answer:

In the name of Allah, Most Compassionate, Most Merciful,

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Brother Mahbub,

The statement: “I will divorce you” is merely a threat to divorce and an intention to give divorce in the future. Accordingly, in the enquired situation, the divorce does not take place.[i]

Brother, it is imperative that a person be wary of the things he utters regardless of any emotions he may be experiencing. He should be careful not to say such things that he may regret later.
