In the name of Allah, Most Compassionate, Most Merciful,
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
In the aforementioned agreement, the statement: “if either party announces verbally or in writing that they are running away leaving either of them, then the marriage will end”is merely a promise to divorce. A promise of divorcedoes not constitute a Talāq (divorce) in Sharī‘ah.[i]Accordingly, as long as the husband Ali does not explicitly issue a Talāq(divorce), the marriage will remain intact.
