Can I Withdraw the Death Benefit?

assalamu ‘alaykum wrwb may Allah guide us all to the Right Path āmīn If some money were given to you from a life insurance policy after the death of a relative who listed you as a beneficiary without your knowledge or consent, what is the ruling for this money? what can or should be done with it? and does the relative being a non-muslim mean anything? jazākallohu khairaN wa bārokallohu feekum

1) What was the insurance scheme?
2) Is the policy holder a Muslim or non-Muslim?
3) What is the relationship between the policy holder and beneficiary?

Answer: Clarification from questioner:
1) What was the insurance scheme?
2) Is the policy holder a Muslim or non-Muslim?
3) What is the relationship between the policy holder and beneficiary?
a) Life insurance
b) Non-muslim
c) Brothers
In the enquired situation, since the policy holder is a non-Muslim, you will be entitled to the full death benefit.[i]

ولو أوصى ذمي لذمي أو لمسلم أو مسلم لذمي بالمال جازت الوصية
بدائع الصنائع، كتاب الوصايا، فصل أما شراظ الركن: 7:335
وأما إسلام الموصي فليس بشرط لصحة وصيته فتصح وصية الذمي بالمال للمسلم والذمي في الجملة لأن الكفر لا ينافي أهلية التمليك ألا ترى أنه يصح بيع الكافر وهبته فكذا وصيته

الحربي المستأمن إذا أوصى للمسلم والذمي يصح في الجملة غير أنه إن كان دخل وارثه معه في دار الإسلام فأوصى بأكثر من الثلث وقف ما زاد على الثلث على إجازة وارثه وإن لم يكن له وارث أصلا تصح من جميع المال كما في المسلم والذمي
